حكم دخول العمالة غير المسلمة إلى حدود الحرم المكي “دراسة فقهية مقارنة”
Abstract
This study examines the ruling on the entry of non-Muslim workers into the boundaries of the Sacred Precinct of Mecca, as well as the ruling on the entry of non-Muslims into other mosques, in order to clarify the distinctive status of the Sacred Mosque in this regard as compared with all other mosques worldwide. The study adopts an inductive method to collect relevant texts and reports, a comparative method to present the views of jurists and discuss their evidences, and a descriptive-analytical method to examine the practical applications of the ruling. It concludes that the majority of jurists prohibit non-Muslims from entering the Sacred Mosque and the boundaries of the Sacred Precinct of Mecca, in preservation of the sanctity of the place and based on scriptural evidence. However, another view permits their entry in cases of need, necessity, or legitimate interest, subject to specific regulations. The study further concludes that non-Muslims and non-Muslim workers may enter other mosques when a legitimate religious or missionary interest exists, no harm results, permission is granted by Muslims, and the sanctity of the mosque is preserved. The study recommends maintaining the prohibition on the entry of non-Muslim workers into the Sacred Precinct of Mecca.
الملخص
يتناول البحث حكم دخول العمالة غير المسلمة إلى حدود الحرم المكي، مع بيان حكم دخول غير المسلمين إلى المساجد الأخرى، لبيان خصوصية المسجد الحرام بهذا الحكم دون سائر المساجد الأخرى، واعتمد البحث المنهج الاستقرائي في جمع النصوص والآثار، والمنهج المقارن في عرض مذاهب الفقهاء ومناقشة أدلتهم، والمنهج الوصفي التحليلي في دراسة التطبيقات العملية للحكم. وقد خلص إلى أن جمهور الفقهاء يمنعون غير المسلمين من دخول المسجد الحرام وحدود الحرم المكي؛ صونًًا لقدسية المكان واستنادًًا إلى النصوص الشرعية، مع وجود قول يجيز دخولهم عند الحاجة والضرورة أو المصلحة بضوابط مخصوصة. كما رجح البحث جواز دخول غير المسلمين والعمالة غير المسلمة إلى المساجد الأخرى عند تحقق مصلحة شرعية أو دعوية، وانتفاء المفسدة، وبإذن المسلمين وحفظ حرمة المسجد. ويوصي البحث بالالتزام بمنع دخول العمالة غير المسلمة إلى الحرم المكي.
